Terms of Service

Effective October 5, 2026

These terms are an agreement between you and Michael Rubenstein ("we", "us"), who makes Nestling. They cover your use of the Nestling iPhone app and the website at nestling-c06f2.web.app (together, "Nestling"). By creating an account or using Nestling, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Nestling.

1. Nestling is not medical advice

Nestling is a logging and organizing tool for parents and caregivers. It is not a medical device and does not diagnose, treat or prevent any condition. Growth percentiles (based on the WHO Child Growth Standards), milestone checklists (based on the CDC's "Learn the Signs" materials), vaccine timing suggestions, diaper color notes, fever flags and dosing reminders are general information only and may not apply to your child.

Always rely on your pediatrician or another qualified health professional for medical decisions, including medicine doses. If you think your child may have a medical emergency, call 911 or your local emergency number right away. Don't delay care because of anything shown in Nestling.

2. Who can use Nestling

You must be at least 18 years old, or the age of majority where you live, to create an account. Nestling is meant for parents, guardians and caregivers. Children should not create accounts. You're responsible for making sure you have the right to log information about any child you add.

3. Your account

4. Family logs and sharing

A family log can be shared with other people using its invite code. Everyone who joins a family log can see, add, change and delete everything in it, including entries, measurements and photos. Only share your invite code with people you trust. The person who started the family log is its owner; if the owner deletes their account while others are still members, ownership passes to another member.

5. Your content

"Your content" means what you put into Nestling, such as entries, notes, measurements, names and photos. You keep ownership of your content. You give us a limited permission to store, copy, process and display it only as needed to run Nestling for you and the people in your family log, such as syncing it between devices. We don't use your content for advertising and don't sell it.

You're responsible for your content. Only upload photos and information you have the right to share, and don't upload anything illegal or anything that violates someone else's privacy or rights.

6. Acceptable use

Please don't misuse Nestling. For example, don't:

We may suspend or close accounts that break these rules.

7. Third-party services

Nestling relies on services from other companies, including Google Firebase (sign-in, data storage and photo storage), Google Sign-In and Sign in with Apple. Your use of those services is also subject to their own terms. We're not responsible for outages or changes in services we don't control.

8. Price and changes to Nestling

Nestling is currently free and has no ads or in-app purchases. We may add, change or remove features, or stop offering Nestling. If we plan to shut Nestling down, we'll try to give you reasonable notice so you can save anything you want to keep.

9. No warranty

Nestling is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including that Nestling will be accurate, error-free, secure or always available, or that data will never be lost. Keep your own copies of anything important, such as photos.

10. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of Nestling or your inability to use it, including any decision made based on information shown in Nestling. Our total liability for any claim related to Nestling is limited to US$50. Some places don't allow these limits, so they may not fully apply to you.

11. Ending your use

You can stop using Nestling and delete your account at any time. We may suspend or end your access if you break these terms or if we stop offering Nestling. Sections 1, 5 (your responsibility for your content), and 9 through 13 continue to apply after your use ends.

12. Apple App Store

If you downloaded Nestling from the App Store, these terms are between you and us, not Apple. Apple isn't responsible for Nestling, its content, maintenance, support or any claims about it, and has no warranty obligations for it beyond what Apple's own terms say. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of the app must also follow Apple's Media Services Terms and Conditions, and Apple's Licensed Application End User License Agreement applies where these terms don't address something.

13. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules, except where the law where you live requires otherwise. Before filing any claim, please contact us so we can try to resolve the issue informally.

14. Changes to these terms

We may update these terms from time to time. We'll post the new version here with a new effective date, and for significant changes we'll also let you know in the app. If you keep using Nestling after the changes take effect, you accept the updated terms.
